Im Falle der Verurteilung droht ihm die Todesstrafe in der für ihn als athenischen Bürger privilegierten Form der Verabreichung eines Gift-Trankes, eines Schierlings-Bechers.

Sokrates, etwa im Jahre 469 vor Christus geboren, wurde um Jahre 399 der Prozess gemacht. Ihm wurde wegen "Asebie", also Unfrömmigkeit, der Prozess gemacht und er wurde für schuldig erklärt. Unmittelbar an den Schuldspruch schloss sich eine zweite Verhandlung über das Strafmaß an. Die Ankläger hatten die Todesstrafe gefordert. Dem Angeklagten stand nach dem Gesetz das Recht zu, eine andere Strafe zu fordern, gleichzeitig aber seine Schuld anzuerkennen.
