  • Partner Visa Appeals: Is Staying Together for Years Enough to Win?
    14 Oct 2026

You've been waiting years for your Australian partner visa appeal. You're still together, and your relationship is going strong. Does that mean you're more likely to win your ART appeal?

Many couples assume that continuing to live together for two or three years after a partner visa refusal is enough to demonstrate that their relationship is genuine and ongoing.

But a genuine relationship does not automatically resolve problems in the original application.

In this episode of Australian Migration Talks, Alex speaks with Jasmine about the issues partner visa applicants should not overlook while waiting for an appeal before the Administrative Review Tribunal (ART).

Drawing on a previously handled partner visa appeal that was ultimately successful, Jasmine explains why the passage of time alone cannot make an incomplete case complete.

    In this episode, we discuss:

    • Does a longer relationship improve your chances of winning an appeal? Why staying together for years does not automatically resolve the concerns behind the original refusal.

    • Can more bank statements solve financial evidence problems? Why applicants need to explain how they share expenses, manage money, and organise their lives together.

    • Do problems in the original application still matter? Why inconsistencies in relationship timelines and gaps in earlier explanations should not simply be overlooked.

    • What if your circumstances have changed while waiting? How changes in living arrangements, financial responsibilities, and family circumstances may need to be reflected in updated evidence.

    • Can new relationship evidence fix old problems? Why recent evidence can strengthen an appeal but may not replace an explanation of earlier inconsistencies.

    • When should you prepare for your ART hearing? Why waiting until a hearing notice arrives may leave important details harder to recall and evidence more difficult to organise.

Jasmine also shares lessons from a successful partner visa appeal, highlighting the importance of reviewing the original refusal concerns alongside the couple's relationship history and subsequent developments.

The key takeaway: Your relationship may have continued, but your appeal still needs careful preparation. Address the original concerns, update relevant evidence, and explain how your circumstances have developed since the refusal.

If you are waiting for an Australian partner visa appeal, have received a partner visa refusal, or want to better understand the role of relationship evidence in an ART review, this episode offers practical insights into the issues that deserve attention.

  • Your Employer Still Wants to Sponsor You — So Why Can Your Visa Appeal Still Go Wrong? | 482 & ART Appeal
    4 Oct 2026

Your employer still wants to sponsor you. So why can an employer-sponsored visa appeal still go wrong?

For many applicants, an employer’s continued support feels like the most important sign that an appeal will succeed. If the business still wants to sponsor them, it can be tempting to think that all they need to do is explain the original refusal and wait for the ART review.

But an employer-sponsored visa case can change significantly while an appeal is pending.

In this episode of Australian Migration Talks, Alex and Jasmine examine a recent 482 visa matter where the employer’s sponsorship refusal was under ART appeal, but the associated nomination had already been withdrawn. The existing visa application could no longer proceed under the original arrangements.

This raises an important question: even if the sponsorship appeal succeeds, what does that actually resolve?

Jasmine explains why applicants and employers need to look beyond the original refusal and keep track of:

    • The current status of the sponsorship application • Whether the nomination is still valid • The status of the visa application • Changes to the business and its operations • Changes to the nominated position and duties • New information arising during the ART appeal

The episode also explores why an employer saying “we still want to sponsor this person” is not the same as proving that the business still needs the role and that the overall application remains viable.

If you are dealing with an employer-sponsored visa refusal, 482 visa, nomination issue, sponsorship refusal or ART appeal, this episode explains why waiting for the appeal outcome may not be enough.

Listen to the full episode to understand what can happen between an employer’s continued support and actually obtaining the visa.

  • Why You Shouldn't Just Submit Whatever the Department Lists in an s56 Request
    28 Sep 2026

Receiving an s56 Request for Further Information from the Australian Department of Home Affairs does not always mean that you are simply missing a document.

Many visa applicants treat an s56 request like a checklist: if the Department asks for bank statements, provide bank statements; if it asks for employment evidence, provide an employment letter; if it asks for relationship evidence, upload more photos and chat records.

    But is that really enough?

In this episode, Alex and Jasmine discuss what an s56 request may actually mean during the Australian visa application process, and why applicants should look beyond the documents specifically listed in the request.

They discuss common situations involving partner visas, student visas, financial evidence, employment history, course choices, business operations and immigration history, and explain why simply providing more documents may not address the Department's underlying concerns.

The episode also explores an important issue: why applicants should always review their original visa application, statements, timelines and previously submitted evidence before preparing an s56 response.

A new document or explanation that contradicts information already provided can create further questions instead of solving the original problem.

If you have received an s56 request, are preparing an Australian visa application, or want to better understand how further information requests are handled, this episode provides practical insight into what to look for before responding.
